Rules of Academy for East-Asian Tort Law Chapter I: General Principles
Article One: Academy for East-Asian Tort Law is a cross-border academic group for academia of tort law and legal practitioners of all jurisdictions in East Asia. English name of the academy is “Academy for East-Asian Tort Law”, hereinafter refer to as AETL.
Article Two: The purpose of the Academy is to unite tort law researchers and legal practitioners of all jurisdictions in East Asia and other parts of Asia, to study tort law of all jurisdictions in East Asia, formulate “Model East-Asian Tort Law”, promote the unification of tort laws in this area, and lay a foundation for a unified tort law of Asia.
Article Three: The Academy respects relevant legal systems of all jurisdictions, and performs academic and research activities independently.
Chapter II: Tasks
Article Four: The tasks of the Academy includes: 1. Organize tort law researchers and legal practitioners of various jurisdictions in East Asia to perform a thorough study on the theories of tort law; 2. Comprehensively promote the formulation of Model East-Asian Tort Law; 3. Organize the tort law researchers and legal practitioners of all jurisdictions in East Asia to carry out investigation and research, report the latest developments in the application of tort law, and promote the exchange and communication of information; 4. Organize the tort law researchers and legal practitioners of all jurisdictions in East Asia to participate in the tort-law-related legislative programs and the work concerning drafting, amending, consulting and justification of law and regulations in all jurisdictions; 5. Initiate and promote the academic exchanges and cooperation between the research institutions in East Asia and the world; 6. Edit and publish books and journals on tort law study in East Asia; 7. Join in the tort law education in all jurisdictions in East Asia, and help to prepare the back-up talents.
Chapter III: Members
Article Five: The applicants for the Academy shall be the researchers on East Asia tort law, legal practitioners and people from all walks of life, who support the rules of the Academy, have theoretical basis of tort law or have acquired practical experiences. To become a member, the applicant shall forward a personal application, be introduced by at least one Academy member and approved of by the Directors Committee of the Academy.
Article six: When the member chooses to withdraw by his/her own will, he/she shall present a written notice to the Directors Committee of the Academy.
If the member has severely broken the law, the Directors Committee of the Academy has the right to deprive him/her of his/her membership.
Article Seven: The members enjoy the following rights: 1. Right to vote, and right to elect and be elected; 2. Right to participate in the academic and research activities and other activities organized by the Academy and relevant research institutions; 3. Right to use all the materials and publications edited and printed by the Academy; 4. Right to supervise, suggest and criticize the work of the Academy.
Article Eight: The obligations of the members: 1. Observe the rules of the Academy, and execute its decisions; 2. Undertake the tasks assigned by the Academy; 3. Participate in academic activities organized by the Academy and distribute the research findings; 4. Actively help to raise research fund.
Chapter IV: Organization
Article Nine: Formed by all the Academy members, the Representative Conference enjoys the highest power.
Its duties include: 1. Formulate and amend the rules of the Academy; 2. Review the work report of the Directors Committee; 3. Discuss and decide the major events of the Academy.
Formed by all the Academy members of each jurisdiction, the Representative Conference of each jurisdiction enjoys the highest power in sub-committee of each jurisdiction.
Its duties include: 1. Formulate and amend the rules of the sub-committee in each jurisdiction of the Academy; 2. Elect general director of the sub-committee in each jurisdiction; 3. Discuss and decide the major events of the sub-committee in each jurisdiction of the Academy.
Article Ten: The general director of the sub-committee in each jurisdiction is elected from its members during the Representative Conference of each jurisdiction. The tenure of each general director is five years. The duties of the General Director include: 1. Organize academic activities in each jurisdiction of the Academy; 2. Recommend scholars in each jurisdiction to participate in the research of special committees; 3. Recommend scholars in each jurisdiction to undertake members of the Secretariat.
The Directors Committee is formed by the general directors from all jurisdictions. Its duties include: 1. Discuss and decide the major events of the Academy during the close period of the Representative Conference of the Academy; 2. Prepare the work report of the Directors Committee of the Academy; 3. Appoint the members of the Secretariat; 4. Establish special committees and review the research schedule of special committees; 5. Invite consultants for the Academy.
Executive Director of the Directors Committee shall be the general director of each jurisdiction, each serving for the Academy for one year according to the alphabetic order of each jurisdiction.1 Executive Director is responsible for organizing conferences of the Academy of this year.
Article Eleven: The Secretariat is established in the Academy. A Deputy Director and General Secretary, an assistant for the General Secretary, and a Deputy General Secretary for each jurisdiction are appointed, each serving for five years.
General Secretary is in charge of the Secretariat, and the Assistant for General Secretary assists the work of General Secretary; Deputy General Secretary is responsible for the specific work of his/her own jurisdiction.
The duties of Secretariat include: 1. The daily work of the Academy; 2. Help Executive Director to organize annual meeting and other academic activities; 3. Translate relevant academic literature; 4. Pursue other activities that conform to this Rule and the purpose of the Academy.
Chapter V: Funds
Article Twelve: The funds of the Academy come from: 1. Social assistance; 2. Financial support from the organizations and institutions where members of the Academy serve; 3. Earnings from publication; 4. Other sources
Chapter VI: Supplementary Articles
Article Thirteen: This rule becomes effective on the day of approval.
Article Fourteen: The interpretation of this rule is up to the conference of Directors Committee.
