Notice of Academy for East-Asian Tort Law NO.2, 2010 -----------------------------------------------------------------------------
Yichun Declaration of Academy for East-Asia Tort Law
Tort law serves as the protective law for civil rights and the restrictive law for tort liability. To protect civil rights is to consolidate the root of the civil law; and to restrict tortious liability is to maintain the basis of liberty. As the common market in East Asia is taking shape, the civil rights of the market participants need to be protected, and the freedom to act of the civil subjects be maintained. However, since the tort laws of various jurisdictions are different, it may pose a limit or even an obstacle to the flow of capital and personnel, and thus hampers the development of the common market in East Asia.
More than 20 scholars of tort law from mainland China, Japan, South Korea, Taiwan, Hong Kong and Macao got together in Yichun, Heilongjiang Province, China, for the establishment of Academy for East-Asian Tort Law and the grand program of formulating the Model East-Asian Tort Law. The participating experts and scholars discussed and unanimously agreed to establish “Academy for East-Asian Tort Law” (hereinafter refer to as AETL) and pass “Yichun Declaration”. The purpose of the Academy is as follows: to unite legal scholars and professionals of tort law in jurisdictions in East Asia and other parts of Asia, study tort laws in East Asia, formulate “Model East-Asian Tort Law”, promote the unification of tort laws of East Asia, and lay a foundation for a unified tort law of Asia.
